PLEASE READ THESE TERMS CAREFULLY. THESE TERMS CONTAIN AN ARBITRATION AGREEMENT WHICH REQUIRES THAT MOST DISPUTES BETWEEN YOU AND CAVALIERI FLOORING BE RESOLVED BY BINDING ARBITRATION. BY PURCHASING PRODUCTS FROM CAVALIERI FLOORING, YOU AGREE TO WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATION.
Your offer to purchase goods or services from Cavalieri Flooring ("Company", "we", "us", or "our") is accepted solely upon the terms and conditions set forth herein.
Any additional or different terms proposed by the buyer are rejected unless agreed to in writing by Cavalieri Flooring.
References to:
Payment in full (100% of product cost and shipping) is required at the time an order is placed and prior to shipment.
Orders will not be processed or shipped until payment has been received and confirmed.
Upon receipt of goods, the customer must inspect all items immediately.
Any claims regarding:
must be submitted in writing within seven (7) business days of delivery. Failure to provide written notice within this period constitutes full acceptance of the goods.
A defect affecting part of an order does not constitute grounds for rejection of the entire order.
Products are shipped via third-party freight carriers. Customers requesting specific carriers or expedited shipping must specify this at the time of order placement.
All shipping charges are the responsibility of the customer unless otherwise agreed. Estimated transit times are typically 5–7 business days within the continental United States, but delivery dates are not guaranteed.
Cavalieri Flooring shall not be liable for delays caused by events beyond our control, including but not limited to:
Risk of loss passes to the customer once the goods are delivered to the freight carrier.
Except for manufacturer warranties provided with the product, Cavalieri Flooring makes no additional warranties, express or implied. This includes but is not limited to:
To the fullest extent permitted by law, Cavalieri Flooring's total liability for any claim arising from the purchase or use of products shall not exceed the purchase price paid for the product.
Under no circumstances shall Cavalieri Flooring be liable for consequential damages, economic losses, lost profits, incidental damages, or indirect damages.
Some jurisdictions do not allow certain limitations, so these exclusions may not apply to all customers.
Risk of loss transfers to the customer once the goods are presented to the shipping carrier. Title to the goods remains with Cavalieri Flooring until full payment has been received.
Cavalieri Flooring is not responsible for damage or loss caused by freight carriers during shipment.
Unless otherwise specified in our Return Policy, all sales are final. Products ordered incorrectly cannot be returned without prior written approval.
If Cavalieri Flooring approves a return:
Orders are processed as they are received. Once an order enters production or shipping preparation, cancellations or changes may not be possible.
If changes are approved, they may result in shipping delays or additional charges.
Many flooring products sold by Cavalieri Flooring are manufactured from natural materials, including wood and bamboo. Natural variations in color, grain, pattern, texture, and shade are normal and not considered defects.
Flooring purchased at different times may come from different production lots and may not match previous purchases exactly.
Customers must inspect flooring materials before installation. Installation constitutes full acceptance of the product.
Cavalieri Flooring is not responsible for issues caused by:
Products that have been installed, cut, or modified cannot be returned or exchanged.
Wood, bamboo, and laminate flooring products are sensitive to environmental conditions. Customers must maintain appropriate humidity levels (generally 40%–60% relative humidity) to prevent excessive expansion or contraction.
Failure to maintain proper environmental conditions may result in flooring movement or damage, which is not considered a manufacturing defect.
Prior to installation, the installer must conduct proper moisture testing of the subfloor according to manufacturer installation guidelines.
Cavalieri Flooring is not responsible for flooring failures caused by improper moisture testing or unsuitable subfloor conditions.
Any disputes arising from purchases made with Cavalieri Flooring shall be resolved through binding arbitration rather than court litigation, except where prohibited by law.
Either party may pursue claims in small claims court if the claim qualifies.
All disputes must be resolved individually. Customers may not bring claims as part of a class action, consolidated action, or representative proceeding.
These Terms and Conditions shall be governed by and interpreted under the laws of the State of Florida, without regard to conflict of law principles.
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
